Meeting Minutes
April 20, 2004

Members present: Terry Silverman, Chairman, Robin Haynes, Carlotta Lilback Pini, and Suzanne Gray
Members absent: Paul Grasewicz; Vice-Chairman, and Macreay Landy
Selectmen present: Andrew Clukey

Chairman Silverman opened the meeting at 7:00 p.m.

PUBLIC HEARINGS


7:15 p.m.     CONTINUED PUBLIC HEARING for David & Tammy Donlon’s proposed three lot subdivision of land located at 816 NH RT 119 West, Tax Map 10; Lot 16-5 in the Rural District – Chairman Silverman opened this continued public hearing at 7:15 p.m. Jillian Maki from Graz Engineering was present. Dave said they walked the wrong area during the site walk. The wetlands have been re-flagged. There were 3 driveway flags, and it turns rather than going straight, where they went through. Terry suggested that they add a note to the plan to keep the driveway location where it is shown and specify that it cannot be changed. The note should also state that this would need a wetlands hearing about the construction. Ms. Maki said that the driveway is not crossing the wetlands. It turns there and goes off to the left. She added that it is very narrow. Chairman Silverman asked Jeanne Sable if the Conservation Commission had any notes regarding the site walk. She said they did not have any yet, although Katie Metzger had suggested making sure the driveways were built up enough.  Carlotta asked if a culvert would be needed. Terry said that he wants a driveway plan for a future wetlands hearing. Terry moved for passage of the subdivision with a permanent driveway shown, a note to that effect and a note stating that a driveway plan would need to be made along with the wetlands application at the time of building.  Carlotta seconded the motion.
Robin said she did not see anything but wetlands in the area. She doesn’t feel that there is enough room for a driveway, but suggested that we might have a soil scientist look at it. Jillian said Paul is one. Jillian said that the wetlands are separated by at least 12’. Robin said that there is no way to do this without impacting wetlands and asked how they could approve the subdivision without knowing that the driveway would be accepted. Jillian said that on the second plan, the wetlands line is new and the driveway is separated higher.
Terry said he feels that if the engineer signed off on this, then he would be responsible.  Terry read 127-16.1D.7C, in reference to conditional use approval. He suggested that they might want to see a driveway plan, along with the conservation commissions’ recommendation. A more concrete driveway plan is needed due to the wetlands ordinance. It needs to be addressed, and if it doesn’t work, an arrangement needs to be worked out.
Dave said there is no other way to go in there. He questioned why he had to deal with so many boards. Robin said they have to go through the proper channels. Terry explained that he has only two Boards to deal with. Terry said that they looked at the wrong driveway, and could not see how much wetlands this will disturb. He said that Dave will have to pay for the plan by his engineer, and he can pass the costs onto the buyer.
Jillian asked what they want to see. She explained that Dave did not walk them through the right area. Terry noted it is approvable under Conditional Use Approval. Terry said he stands by his motion to approve it and warn the potential buyer that they need to come before the Planning Board before driveway construction to protect the wetlands. Suzanne said that she prefers to take another site walk. Terry asked for a vote on the motion. 1 voted in favor, and 4 voted against the motion. The Board decided to do a new site walk, only in the area where the driveway would go. They scheduled it for Monday, April 26, at 7:00 a.m. and asked Jeanne to relay the information to the Conservation Commission. The Public Hearing was closed at 7:47 p.m. and continued to May 4, at 8:00 p.m.

7:30 p.m.     CONTINUED PUBLIC HEARING for Roy Bros. Oil & Propane for a Site Plan Review Modification to allow one additional 30,000 gallon propane tank at the facility located at 193 NH RT 12 North, Tax Map 15; Lot 28, located in the Light Industrial and Rural Districts – Nancy Carney from the Fire Department was present. She provided their recommendations. She said that propane delivery trucks should not be between the building and the tanks. They have a concern with access to the tanks and water supply. Concord Industries' water supply, if used, would leave them empty. She recommends they consider a dry hydrant, at the bottom of the hill on the dump side, which would need State approval. She said they were hoping for access from the Concord Industries’ side, but it’s not possible. She said they would like to have access to Northeast side of the lot, which has a 10-20’ drop, so they can get trucks in from Northeast side. There is a concern over tanks getting heated, and they want to be able to access the parking lot.
Bob said that would require State approval. Bob suggested converting one of the old oil tanks to a water tank. He said that State laws require the tanks have to be completely cleaned out. He said they are willing to do that. Nancy said that the Fire Department would like to work with Roy Bros and the State. Bob said he will make sure the trucks are not parked next to the building and tanks. Terry noted that Roy Brothers talked about bio-diesel in the last Site Plan. Terry asked if they would do a formal site plan with these conditions, namely the parking, dry hydrant or storage option and also the possibility of access from the North end of the property. Bob agreed. The public hearing was closed at 7:55 p.m., and continued until this is worked out (tentatively, the  bMay 4 meeting).     

Preliminary Consultation

7:00 p.m.      Preliminary Consultation with Sean McGarry to discuss removing the existing duplex located at 309 East Lake Road and building a duplex in a different footprint on this property known as Tax Map 7; Lot 18 in the Rural District – Mr. McGarry did not show up for his appointment.  

7:45 p.m.      Preliminary Consultation with Jim Carter of Carter Construction for a Home Business/Home Occupation at property located at 184 NH RT 119 East, Tax Map 12; Lot 15 in the Rural District – Mr. Carter explained that he is a registered contractor in Massachusetts. He is planning to purchase a home on Rt. 119, pending results of a water test. He currently operates a home business in Massachusetts. He provided a simple proposal for a sign, which is 4’x2’ 6” w/4x4 p.t. posts and double sided, minimal floodlights. He showed the Board pictures of his current shop, and explained that there is no heavy equipment, he has 2 to 3 employees, and works out of a one bay garage. There was another picture of the home he is looking at, which also has a one bay garage. He explained that he just does carpentry work and home improvements, so it is a “load and go” operation. He plans to advertise in local newspapers and have a simple sign. Robin questioned the number of vehicles. He said he has only one small truck, but is looking for a bigger truck to pull a trailer. His employees meet him in the morning, they load up and leave. There will not be any chemicals or solvents on the property. He would use the existing garage for his shop. Terry noted that this would fall under a Home Occupation and it does not require site plan review. He added that the Sign permit goes through the Selectmen. The Board agreed.               

8:15 p.m.      Preliminary Consultation with Margo Best for a Home Business/Home Occupation at property located at 76 Columbia Road, Tax Map 28; Lot 13 in the Residential District – Margo said she has bee training for a month and a half to selll health and nutrition products. Sales would be mostly by Internet and telephone, with no retail sales on site. There would be no employees. She will get Fed Ex deliveries from time to time, but the products are drop shipped to the customer. The board agreed it’s a home occupation, and does not require site plan review. Terry moved that it’s a home occupation. Robin seconded the motion. The board voted unanimously in favor of the motion.

Administrative Work

Ø       Review and approve meeting minutes and Non-Public meeting Minutes from April 6, 2004 – Robin moved to accept the minutes as written. Suzanne seconded, and the board voted unanimously in favor of the motion. Non-Public; Suzanne moved to accept the minutes as written, Andy seconded, and the board voted unanimously in favor of the motion.  
Ø       Discuss Master Plan Update – Robin provided a rewrite of the Police Dept. section.  
Ø       Review Recreation & Open Space Section – The Board needs a list of town owned property and the status of the Katie Metzger forest.   
Ø       Appoint Planning Board member to serve on the CIP Committee – Suzanne moved to appoint Carlotta as the Planning Board’s member. Terry seconded, and the board voted unanimously in favor of the motion.    

Correspondence

Ø       Memo from Paula Thompson; Town Administrator re: appointing Board member to the CIP Committee.
Ø       Copy of letter sent by the Board of Selectmen re: Tax Map 12; Lot 02. No action taken.
Ø       Notices of Public Hearing from the Town of Winchendon - No action taken.
Ø       Notice of Decision from the Town of Winchendon - No action taken.
Ø       Notice of Decision issued by the Zoning Board of Adjustment - No action taken.
Ø       Copy of Sign Permit Application approved for Fitzwilliam Antiques located at Concord Industries, Map 15; Lot 29 – Margo told the Board that this application has been approved .
Ø       Spring 2004 Edition of “The Source” – Robin took it to review.
Ø       Information from Jeff Porter of SWRPC re: Brownsfields Program, Site Nominations, etc. – The Board questioned whether we have a site in town. Margo will send a memo to the BOS to ask if they have any knowledge of this.


Terry and Robin signed the final plans and Mylar for Russ Raito’s housing development.


Carlotta moved to adjourn at 8:25 p.m. Suzanne seconded, and the board voted unanimously in favor of the motion.
