Planning Board Meeting
December 21, 2004

Members present: Terry Silverman; Chairman, Paul Grasewicz; Vice-Chairman,  Carlotta Lilback Pini, Macreay Landy, Suzanne Gray, and Andrew Clukey, Selectmen’s representative.
Members absent:  Robin Haynes
Others present: Carmen Yon; Chairman of the Conservation Commission, members of the public.

Chairman Silverman called this meeting to order at 7:03 p.m.

Minutes:  The Board reviewed the December 7, 2004 minutes, which were recorded by Carlotta Lilback Pini.  Silverman moved, Gray seconded and the Board approved the minutes as written.

Voluntary Merger:  Grazewicz recused himself, as engineer of record.  The Board reviewed the voluntary merger plan, which shows the two parcels being separated by a Class VI road.  In 1827 the road was called the Ashuelot Turnpike, which was downgraded to Class VI in 1971. Since the Town has not discontinued the road and the two lots are therefore not contiguous, the Board questioned whether a merger of these two lots could take place.  Referring to A Hard Road to Travel, Pini suggested the lots may be contiguous for some purposes.  The Board recalled several properties where the home is on one side of a road and the barn or garage is on the other.  

The Board agreed to table the discussion until legal opinion could be obtained.  They will revisit the issue after conferring with the NH Municipal Association.

McLaughlin Wetlands Application:   Silverman moved, Gray seconded and the Board approved the application as complete.

Grazewicz presented the plans.  To gain access to a back lot, the McLaughlins need to cross an intermittent stream.  An expedited application has been filed with the State.  They propose to replicate the wetlands that will be disturbed by the crossing at the site of an old logging trail.  Following best practices, they will excavate an area, equal to the disturbed wetlands, to a depth lower than the existing wetlands and fill it with organic soil.  A 15” culvert will be installed at the stream crossing and erosion controls will be put in place.  

Silverman referred the Board to RSA 674.21.  The Board agreed that the project meets the four conditions outlined in the Land Usage Code, section 127.16.1, D4. Silverman moved, Pini seconded and the Board voted unanimously to give conditional approval to the project, providing the wetland replication is constructed as noted on the plans, and that the house and septic system are located outside the WPOD (Wetlands Protection Overlay District). A Notice of Decision will be sent.

Heald, Moran, Kates and Wakowski Boundary Line Adjustment (BLA): Grazewicz presented the proposed plans and asked the Board for a preliminary conceptual consultation.  The four land owners have proposed to divide and reconfigure their various properties located on Map 7, lots 31, 42, 32, 28-2 and 28-3c.  

The Board asked the purpose of the adjustment and Grazewicz responded that he wasn’t sure.  No new lots are being created.  Silverman and Landy would like to see two applications, since the BLA involves five separate parcels that are not contiguous.

Land Use and Subdivision and Site Plan Review  Amendments: The Board continued to discuss the best way to preserve the character of the Town through measures that control growth; increasing lot size minimum, ordinances, common driveways and driveway slope requirements, etc.  The Board will continue to review ordinances from other towns.  

Nicole Burke and Michael Prentiss did not attend their scheduled appointments.

Adjournment: Silverman moved, Pini seconded and the Board voted to adjourn at 9:00 PM.
