Planning Board Minutes 03/21/06
Members present: Terry Silverman, Chairman, Robin Haynes, Diane Schott, Paul Grasewicz, alternate, and Andy Clukey, Selectmen’s representative.
Others present: Nancy Carney, Deputy Fire Chief
Call to Order: The meeting was called to order at 7:05 p.m.

Preliminary consultation:  Mary Ellen Theberge to discuss a retail business in her home, located at 147 West Lake Road, Map 11, Lot 1, Rural District.

Mrs. Theberge has purchased the home she discussed with the Board several months ago.  She wants to continue the retail business the former owner conducted on the property for about three years, and presented a copy of the site plan for the former shop.  Mrs. Theberge plans to sell antiques, vintage furniture, lamps, clothing, jewelry, and gifts.  The shop will be open four days a week and she is the only employee.  With the change in the sign ordinance that was passed by town vote on March 14th, Mrs. Theberge may change the size of the sign.

The Board agreed this was a home occupation, under Land Use Ordinance 127-14 A.2. (a), and did not need a site plan review.

Minutes:  The Board reviewed the minutes of the March 7, 2006 meeting.  Haynes moved, Clukey seconded and the Board approved the minutes as amended.

Subdivision hearing continued: Arnie Filipi proposes an eight-lot cluster subdivision of property located on the north side on NH Route 119W, east of Kemp Brook, Map 10, Lot 68, Rural District.

Mr. Filipi wanted to get the Board’s input on naming the subdivision and the private road leading to it.  He suggested ‘Railroad Lot Development’ and ‘Karl’ Lane.  He will check with mutual aid for final clearance.  

He confirmed that the Board has not received a draft of the homeowners’ agreement from Mr. Sheldon.  

Section 221-24 G. of the subdivision regulations call for monuments to mark the bounds of the road and lots. Mr. Filipi asked if they were necessary.  Grasewicz noted that monuments basically define the layout of a new road, and it’s typically the last thing done, before presenting the road to a town for acceptance.  Since this is a private road Grasewicz wondered if it applies.  Mr. Filipi said he was open to having the town accept the road, and Silverman said that is not the intention of the Planning Board or town.  Grasewicz agreed with Mr. Filipi in that at some point the residents may petition the town to accept the road.  He suggested the plat show where the monuments should be placed, since it determines the right of way for the road.  A surveyor sets these points.  Grasewicz said the points are shown on the plan and are set after road construction is complete.

The public hearing is continued to April 4, 2006 at 7 PM.

Public hearing:  Housekeeping changes to subdivision regulations, involving Sections 221-5, 221-12, and 221-19.

1.      Editorial change to Subdivision Regulation Section 221-5; delete the words “Registry of Deeds of Cheshire County” and substitute the words “Town Clerk.”  This change reflects the one made last year to Section 221-4, and is in accordance with RSA 675:8.  Silverman moved, Haynes seconded and the Board approved this amendment.

2.      Editorial change to Subdivision Regulation Section 221-12 to add a definition from Fitzwilliam Land Use Ordinance. The subdivision regulations refer to special flood hazard areas but do not define them.  The definition that exists in the Land Use Ordinance will be duplicated alphabetically in the subdivision regulations Section 221-12: “Special Flood Hazard Area – An area having flood, mudslide and/or flood-related erosion hazards and shown on a Flood Insurance Rate Map as Zone A.” Silverman moved, Haynes seconded and the Board approved this amendment.

3.      Editorial change to Subdivision Regulation Section 221-19 to change time limit per RSA. RSA 676:4 1.c. (1) states that upon determination that a submitted application is complete, the board shall begin formal consideration and shall act within 65 days, subject to extension or waiver. “Within sixty-five (65) days” will be substituted in Sections 221-19 A. and 221- 19 C for “within ninety (90) days”. Silverman moved, Haynes seconded and the Board approved this amendment.

Preliminary consultation:  Christopher Stevens proposes to open a fish and game shop in the Crossroads complex, the former clock shop, Map 34, Lot 28, Gen. Business Dist.

Mr. Stevens plans to open a sporting goods store in the Bateman building, formerly a clock shop.  He will sell fishing equipment, clothing and supplies.  He plans to live in the building, which is a continuation of a permitted use with a special exception for a combination business and dwelling.  The Board noted this is a rental property and there is adequate parking for both customers and residents.

When asked if he planned to sell guns, he replied ‘not at the moment.’  He may sell fishing and hunting licenses. Haynes noted the town needed a deer checking station and Mr. Stevens said ‘maybe, in time.’



Silverman asked what the water requirements might be for this business.  Mr. Stevens plans to have a tank inside the building for live minnows.  He added that all business will be conducted within the building.  

The consensus of the Board was that a site plan review was not needed.

The meeting was adjourned at 7:45 PM.
