BOARD MEETING MINUTES
February 26, 2003

Selectmen Present:  Mrs. Silverman, Mrs. Knight and Mr. Clukey


PRIMARY:

7:30            MEET WITH MARY TOMMILA
Re:  Building status of Tax Map 37 Lot 02:  The board looked into                
the original subdivision. It does not appear that this lot was part of the
original subdivision.  Mrs. Tommila stated that she is interested in selling         
this lot and she would like to know if this is a building lot.   Mrs.
Silverman stated that we looked into this and there appears that just
beyond her lot there is a recorded subdivision. In the past we have issued
permits for lots that are part of a recorded subdivision.   Since this lot is
not a part of a recorded subdivision we, as a general rule, do not issue
building permits for lots on private or Class VI road unless they are part of
an approved  subdivision.  The board read RSA 674:41 which gives the
Selectmen authority to authorize the issuance of a building permit on a private road after comment from the Planning Board.   The board would
like to meet with the Planning Board to discuss this issue.   Mrs. Silverman stated that Mrs. Tommila’s property is at the end of the private road closer to the Class V road than the other lots that are part of the subdivision (many of these lots already have houses on them).  Mrs. Silverman said that the selectmen would allow these undeveloped lots located in the subdivision on Sunset Road to obtain a building permit, provided they could obtain a state approved septic design and meet all the town and state required set backs.                  

***     REQUEST TO APPOINT MAC LANDY AS TRUSTEE OF ELLIOT INSTITUTE: Mrs. Knight moved to appoint Macreay Landy, Mr. Clukey seconded, the motion passed 3-0.

***     NON-PUBLIC SESSION – PERRY FUND REQUEST:  
                          At 7:55pm, Mr. Clukey made a motion to go into Non-Public Session
                         under RSA 91 A:3 II  (a). Mrs. Silverman seconded the motion. The
                         motion passed 3-0.  Roll  Call Vote; Mrs. Silverman – yes, Mr. Clukey –
                         yes, Mrs. Knight – yes.
                         At 8:00pm. Mr. Clukey made a motion to go out of Non-Public Session
                        under RSA 91 A:3 II  (a). Mrs. Silverman seconded the motion. The
                        motion passed 3-0.


***     SIGN EPA STORMWATER NOTICE OF INTENTS FOR TRANSFER STATION AND HIGHWAY BARN:  Mrs. Thompson and Mr. Cuomo are working on these documents.   

***     REVIEW LETTER AND RESPONSE FROM BERKACH GROUP REALTY TRUST :   This lot is being assessed as undevelopable land  

***     DISCUSS LETTER REGARDING TIMBER HARVEST AND ASSESSMENT OF TIMBER – TAX MAP 06 LOT 47:  The logger requested the timber be taxed lower than what we have figured out at 33%.  The figures they provided are what they were paid it does not take into account the value at mill.  The board feels that we should assess the tax based on 33%.      

***     UPDATE ON POSSIBLE CODE VIOLATION TAX MAP 10 LOT 85:   This is a house on Rt. 119.  There is a repair shop in the garage.  Mr. Prentiss is meeting with the Planning Board next Tuesday with regard to this business.   

***     REVIEW LETTER FROM DEPARTMENT OF SAFETY REGARDING DEFIBRILLATORS:  Mrs. Thompson spoke with Nancy Carney.  She stated that Chief Newton had called her and asked if the fire department would help fund raise for a defibrillator.   She is not sure why the police department wants this item.  They are not usually involved in an accident scene.  Mrs. Silverman would like Mrs. Thompson to speak with Chief Newton to determine if he is interested in this item.  Mrs. Silverman would like to determine if all of the officers are willing to be trained in this device.
