Selectmen's Meeting Minutes 09/10/03
BOARD MEETING MINUTES
     September 10, 2003

Members Present:  Susan Silverman, Andrew Clukey and Joan Knight

Mrs. Silverman opened the meeting at 7:00 PM.

PRIMARY:

***             LETTER OF RESIGNATION FROM KERRY GAGNE:  This is
                        a letter resigning from the ZBA.  The ZBA has two alternates now, they
                        will be meeting next week.  They will discuss which member to make a
                        full time member.   Mrs. Silverman feels that that board needs to think of
                        who we wish to ask to fill this position.  

                        Mrs. Knight stated that we need to think of alternates for the Planning
                        Board also.       

***             REVIEW DECISION OF JUDGE IN DAVIS BANKRUPCY CASE:
                        The Judge has ruled that they are not going to pay the back taxes out of the
                         bankruptcy funds.  We can take the property by tax deed. Mr. Davis’s ex-
                        wife is paying the current taxes.  Mrs. Silverman would like to determine
                         if she has ownership of this property.  If she does not, then she suggested
                         taking this property for tax deed and offer it back for purchase by her.  
                         Mrs. Thompson stated that if she does not have legal ownership of the
                         property,  then we could not directly offer this for repurchase.      Mrs.
                         Thompson will speak with Mrs. Wright to determine ownership of this
                         property.   

***                   Police:  The board would like to meet with Chief Newton with regard to
                         vacation scheduling and the speed board and if it is being used. Mr.
                        Clukey stated that he has heard that at many accidents the State Police
                        respond, and he is questioning if Chief Newton is taking calls.  The board
                        would like to meet with Chief Newton at 7:15 on October 1.   

***     NON-PUBLIC SESSION – PENDING LITIGATION
                          At 7:25pm, Mr. Clukey made a motion to go into Non-Public Session
                        under RSA 91 A:3 II  (e). Mrs. Knight seconded the motion. The  
                        motion passed 3-0.  Roll  Call Vote;  Mrs. Silverman – yes, Mr. Clukey –
                        yes, Mrs. Knight – yes.
                         At 7:35pm. Mr. Clukey made a motion to go out of Non-Public Session
                        under RSA 91 A:3 II  (e). Mrs. Knight seconded the motion. The
                        motion passed 3-0.


***     PUBLIC HEARING FOR STATE OF NH 10 YEAR TRANSPORTATION PLAN – OCTOBER 8 @ 7:00PM IN RINDGE:
                       The Rt. 119 & Rt. 12 intersection is on this plan.  Mrs. Knight suggested having Chief Newton attend this meeting.  Mrs. Silverman suggested someone from the Planning Board may want to attend.  Either Mrs. Favreau or one of the Selectmen will attend this meeting.  Mrs. Silverman suggested having Gene Cuomo attend this meeting.   

***     ADDITIONAL INFORMATION FROM GREEN MOUNTAIN INSTITUTE:  They have forwarded some information with regard to their service.   They will use models that they have.  They are funded by individual companies and the federal government.  They are funded for a single event.  They would talk with Stone Environment.  They provide information and engage people in discussion.  Mrs. Silverman feels that we need to contact the homeowners within the district and explain our last option to explore and determine if they are interested in this.  Mrs. Knight feels that we would need to meet with the Sewer Committee.  Mrs. Silverman stated that she felt that we would first present this in a letterform to them.  Mrs. Knight feels that we need to make sure we give the people enough information for them to make an informed decision.  Mrs. Knight feels that we need to meet with the sewer committee again.  This letter will explain that we need input from the users to determine if this were something they would like to pursue.  The board will send a letter with regard to the updates and the fact that we need them to be a part of this in order to make a decision.  We will hold a meeting that they will all be invited to.  If we do not hear from them by a certain date, we will contact them by phone.   Mrs. Thompson will draft a letter.

***     REVIEW TIMBER WETLANDS PERMIT – TAX MAP 2 LOT 5:  Reviewed

***     DISCUSS DRAFT OF CIP: Mrs. Thompson spoke with Gene Cuomo who added a couple of projects that he would like completed.   He would like to paint the interior of the highway barn.  Replace windows and he would like to tear down the brick building and replace this with a cold storage building.  Mrs. Thompson spoke with Wendy Carney and requested the Firewards give her any input as to projects they would like included.   Mrs. Silverman feels that we should eliminate the radios, base and portables.  Mr. Clukey does not feel that we should.        

***     REVIEW MEMO TO FIREWARDS:  Reviewed

***     DISCUSS LANDSCAPING PLAN FOR RECREATION AREA:  Mrs. Thompson met with Kathy Stark, Barbara Hadsell, and Katie Mezger. The garden club would like to work on a couple projects for the town.  One is the recreation area.  They would like to plant trees and shrubs.  They would also like to complete a project at the library.    They would like to hire a landscape designer to look at these two areas.     They are proposing that the Recreation and Library share the cost of the landscape designer.  The landscape designer would include an itemization of cost.  The garden club would not pay for the recreation area.  They would donate $5000 towards the library plan.  Mrs. Stark is meeting with the recreation commission tonight to discuss this matter.  Mrs. Stark feels that she could come up with about $800 to $1000 in her budget, the library feels that they could come up with about $400.  The garden club is not interested in taking on any more gardens in town.  They will take care of the existing gardens and a butterfly garden that needs to be moved.  Mrs. Silverman is concerned with drainage at the recreation area because of the tennis courts.  Mr. Clukey feels that this is up to the recreation department.  Mrs. Knight is concerned that the departments have the money in their budget to do this and she does not want the garden club to have any control over this once the landscaping has been done.  She also feels that the departments need to have input into the plan.      

***     REVIEW PERRY FUND REPORT:  Reviewed

***     BOAT LAUNCH:  Mrs. Thompson spoke with an attorney at NHMA we cannot spend money on this since this is private property.   We could obtain an easement.  But she would be concerned that the State could take this by eminent domain.      

***                  Mrs. Massin received a complaint from Les Black that the light on the side of the library shines into his bedroom.  This light is on a timer, it shuts off at 10:30.  The board feels that this is a public building and for safety reasons this light needs to remain on until 10:30.

There being no further business, at 8:50 PM, Mrs. Silverman made a motion to adjourn.  Mr. Clukey seconded and the motion passed 3-0.
