Selectmen's Meeting Minutes 11/19/03
BOARD MEETING MINUTES
                       November 19, 2003


Members Present:  Andrew Clukey, Susan Silverman and Joan Knight

Mrs. Knight opened the meeting at 7:00 PM


PRIMARY:

7:00    MEET WITH WARREN HALL, CODE ENFORCEMENT OFFICER:  The board questioned Mr. Hall if he inspected the Vincent property.  Mr. Hall stated that he did not, he has heard talk that the Vincent’s use this property for vehicle repairs.   The board would like Mr. Hall to inspect this property.  Mrs. Knight stated that she is concerned if they are working on friend’s vehicles what they are doing with the waste oil.  

                        Mrs. Thompson feels that we need to determine a level of investigation we need to do prior to sending a property owner a letter of violation.  Mrs. Knight feels that in the future, Mr. Hall needs to physically inspect properties that are in question.     

8:00    MEET WITH BRUCE NEWTON, POLICE CHIEF
·       2004 BUDGET:  Chief Newton stated that he increased the part time officers line up from $10,000 to $18,000.  

Chief Newton stated that he has put money in line 840 for special patrols.  These are refundable by grants available through the State.  Mrs. Silverman questioned if it is feasible to implement these enforcement with the staff we have.  Chief Newton stated that he has four, four hour patrols from June to November for the OHRV patrol.
Chief Newton stated that DWI enforcement would be priority, speed would be second.

Mrs. Silverman stated that she does not see any money in the budget for the K-9.  Chief Newton stated that they are trying to fund this privately through the police association.  Mrs. Silverman feels that the board still needs to be made aware of the cost associated. Chief Newton stated that they are trying to find out if this is a viable option. They are researching whether or not they have support in the community by trying to take pledges.  They are trying to get it started and funded for three years.   Mrs. Knight stated that when they are ready to collect funds they need to meet with the board.

Mrs. Knight stated that we are going to ask Warren to inspect a property.  The board would like an officer to accompany him.       
           
·       Information re: activities:  Chief Newton stated that he has a herniated disk which it has been strongly suggested that he be operated on.  This would lay him up for eight weeks.  

8:30    MEET WITH JANICE ANDERSON
·       Michelson property:   Ryan Roy and Janice Anderson met with the board.   Mr. Roy stated that trash has been piled in the woods.  He stated that the number of people using this property has increased.     
He stated that the number of abandoned vehicles has increased.  Mrs. Knight stated that we will need to have the Code Enforcement Officer inspect this property and document what is there.  Mr. Roy stated that some of these buildings should be condemned.  If Warren Hall inspects and feels that there should be buildings condemned, then we will have Wendy Carney inspect.  

Janice Anderson stated that she is also concerned with Phil Dickenson’s property.  She stated that this is becoming a junkyard.  Mrs. Knight stated that we could try to contact the landowner with regard to this.                

9:00    MEET WITH THE VINCENT’S
·       Discuss letter received from the selectmen:  Kim and Paul Smith, Linda,  Paul and Neil Vincent met with the board.   Mrs. Vincent stated that she would like to see their case file.  Mrs. Knight stated that they had asked the Code Enforcement officer to verify that there was a business on this property.  Mrs. Knight stated that they went on his word, that he did not inspect this property.  Mrs. Knight stated that if they are not running a business at this time, then they do not need to meet with the Planning Board.   Mrs. Vincent stated that she put in writing that the Code Enforcement officer be present at this meeting and he is not present.  Mrs. Vincent stated that this is the second time this issue has come up.  They were also asked to meet with the board in 1999 to meet with the board with regard to this issue.  They would like to know whom the accuser was the first time. This time Paula Thompson asked the Code Enforcement Officer to look into this matter.  Mr. Vincent stated that it bothers him that a taxpayer did not make a complaint.  Mrs. Knight stated that it is incumbent upon Mrs. Thompson in her position to make the Code Enforcement Officer aware of situations happening in town.   Mr. Clukey questioned if there were any unregistered vehicles on the property.  Mr. Vincent stated that there isn’t.  They have mustangs, which they put up for the winter.   Mrs. Smith stated that they have an issue that the Code Enforcement Officer never did an investigation into this matter and stated that there was a business.  Mr. Hall arrived and stated that he had heard around town that they were running a business.  

Mrs. Vincent stated that she still wants to know who her accuser was back in 1999.  The board will look into the minutes with regard to this matter.  Mrs. Smith stated that the reason they are here is that they are really good friends with the Vincent’s and they want to testify that they are not running a business.  

Mrs. Vincent questioned Warren how he came to the conclusion that they were running a business.  Warren stated that he told Mrs. Thompson that he had heard from other people in town that they were running a business.  Mrs. Vincent would like a letter of response with regard to this matter along with the information from 1999.        
                      

***                  The board met with Warren Hall.  Mrs. Knight stated that she feels that as
                        standard procedure, he should look at the file to determine if there are any
                        issues with the property that have come up in the past.  They would also
                        like Mr. Hall to physically view the property.  

                        Mrs. Knight questioned if Mr. Hall has any set hours.  He stated that he
                        comes in the first Wednesday of every month.  Mrs. Silverman stated that
                        this doesn’t work.  We need to have at least one hour during the week that
                        Mr. Hall will be in the office.  Mrs. Silverman stated that they would
                             prefer the paperwork stay in the office.   Mr. Hall stated that he could not
                        be in the office the same time every week.  Mrs. Hall stated that he is not
                        available to do this for the next two weeks.   Mrs. Silverman questioned if
                        this job is working out for him.  Mr. Hall stated that he enjoys the work   
                        Mrs. Knight stated that we have two land use issues that need to be looked
                        into as soon as possible.    


***     ZONING VIOLTION – TAX MAP 28 LOT 20:  We received a call from Cindy Satis asking about a Veteran’s Home.  Monadnock Family Service had referred her to this property for housing for a welfare recipient she was trying to place. They are advertising this house as a safe house.  Apparently they are renting rooms to recovering drug addicts and alcoholics.  The person who is running this is a renter, she does not own the property.  Mrs. Knight feels that we need to send our Code Enforcement Officer to this property along with a police officer to verify this.        
                        Mrs. Thompson will contact Monadnock Family Services to determine how they heard about this house.  

***     BUDGET COMMITTEE MEETING TOMORROW NIGHT:  Win Wright found an RSA that states that if you are a department head you cannot be on the Budget Committee.  He is the department head of emergency management.  Mrs. Thompson verified this with NHMA and they stated that he couldn’t serve in both capacities.  Mr. Wright will be resigning from the budget committee tomorrow evening.     

 ***    INFORMATION REGARDING PETITION FOR TEMPLETON TURNPIKE:  Mrs. Thompson spoke with NHMA with regard to this petition.  This would not be binding.   

***     DISCUSS DRAFT OF LETTER BY ATTORNEY PRIGGE TO GARY SHELDON
·       Woodbrook properties:  Attorney Prigge has drafted a letter he is questioning if they could collect the condo fees before the taxes.  He is suggesting that they pay 50% of the taxes that would be written into the warrant article if we agree to take these for tax deed.      

Mrs. Silverman stated that she would rather come to an agreement with them stating that we would not pay any condo fees if we agree to take these properties for tax deed and sell them the properties.   We will send this letter back stating that we want the condo fees forgiven and we will put these properties on the warrant for the back taxes.    

***     DISCUSS LETTER FROM WATER COMMISSIONERS
·       Re: Requiring approval from commissioners prior to any excavation being approved by selectmen in the village area:  
The commissioners are concerned with any individuals within the water district doing work.  They are requesting that anyone within the district that applies for a building permit that includes excavation they be notified.  The board would like the commissioners to provide us with a list of properties along with the map and lot of properties in the water district.  We will send them a notification of anyone within the district that has applied for a building permit.     

***             REQUISITION FROM RECREATION FOR SOCCER GOALS:
                        This is for the purchase of soccer goals in the amount of $1973.00.  The
                         goals that they have now cannot be firmly secured in the ground.  They
                         feel that this is a safety issue.   Mr. Clukey moved to approve, Mrs.
                         Silverman seconded, the motion passed 3-0.     


***             REVIEW DECEMBER NEWSLETTER ARTICLES:  Reviewed

***             NON-PUBLIC SESSION – PERSONNEL EVALUATION
                           At 7:50 PM, Mr. Clukey made a motion to go into Non-Public Session
                        under RSA 91 A:3 II  (a). Mrs. Knight seconded the motion. The  
                        motion passed 3-0.  Roll  Call Vote;  Mrs. Silverman – yes, Mr. Clukey –
                        yes, Mrs. Knight – yes.
                         At 7:55 pm. Mr. Clukey made a motion to go out of Non-Public Session
                        under RSA 91 A:3 II  (a). Mrs. Knight seconded the motion. The
                        motion passed 3-0.

***     LETTER FROM DES REQUESTING COMMENT ON BEACH MONITERING AND PUBLIC NOTIFICATION PLAN PROPOSED CHANGES:  We test Laurel Lake.  From this letter it looks like they are trying to standardize how this testing is done.  Mrs. Thompson gave a copy of this letter to Wendy Carney.    

***     MRSD MEETING TO DISCUSS BUILDING PROPOSALS
        December 4, 2003:  This is at 7:00 at Monadnock Regional High School.  There is a budget committee this evening.   Mrs. Silverman suggested that we get a group of people together that have an interest in this issue form a committee to look into these issues.  We will put an article in the newsletter asking for anyone interested to contact us.  We will put a notice on the Fitzwilliam net.  

***     GOVERNOR’S ADVISORY COMMISSION MEETING TO REVIEW PUBLIC HEARING NOTES AND MAKE CHANGES TO THE TEN YEAR PLAN:

There being no further business, at 9:55 PM, Mrs. Silverman made a motion to adjourn.  Mr. Clukey seconded and the motion passed 3-0.
