BOARD MEETING MINUTES
July 14, 2004
Selectmen Present: Mrs. Silverman, Mrs. Knight and Mr. Clukey
Mrs. Silverman convened the meeting at 7:00pm.
Jason Hill is here to see the selectmen. He has the signed road agreement that was required by the ZBA and the selectmen. Mr. Hill would like the selectmen to provide a letter acknowledging receipt of the signed road release signed by them and Mrs. Thompson. Mrs. Silverman offered a copy of the signed road release and Mr. Hill said that would be fine. The release was signed by the selectmen and Mrs. Thompson witnessed the signatures and gave Mr. Hill a copy.
Mrs. Silverman stated that we still have not received a construction permit for the trailer that Mr. Hill placed on his property in February despite their request for one. Mrs. Silverman reviewed with Mr. Hill that the trailer has been gutted and therefore is a storage unit. She told him that the fee is $70.00, double the normal fee since our regulations require double the normal fee for issuing a construction permit after the fact. Mrs. Thompson gave Mr. Hill a copy of our construction permit regulations and instructions and a construction permit application. Mr. Hill said that he would complete and submit the permit application.
7:15pm MEET WITH JULIE SKINNER
· Questions regarding Tax Map 04 Lot 17-01
Ms. Skinner did not show up for this appointment. Mrs. Thompson reviewed the questions Ms. Skinner asked her on the phone earlier in the week. She is wondering what types of repairs can be made to the cottage located on this property that has no access. Mrs. Silverman said that she could repair the existing structure. Mr. Clukey questioned if she could replace the foundation. Mrs. Silverman is not sure about this. The important thing is not to expand the non-conforming use. Sonar tubes would be OK but a full foundation would not. She could change the type of support to prevent it from falling down but we would need to be very specific about what is and is not allowed.
*** DISCUSS LETTERS FROM MR & MRS CHURCHILL
The Churchill’s responded to the board’s letter with a letter we received Friday saying that they would be painting the fence a dark green color. We received a letter from them today with a picture of the Robbins Road side of the fence painted. They will continue the painting – as the weather allows.
*** DISCUSS COMPLAINT REGARDING 791 TEMPLETON TRNPK
Mrs. Silverman wants to know what they are doing that is not legal. Andy says they have bonfires and questions if they have a permit? They have dogs and he questions if they registered? The noise level is loud. Mrs. Silverman noted that most of the complaints need to be addressed by the police. We will copy the Chief this letter of complaint. We will notify Mr. Mattson that they are doing open burning. We will notify the dog officer. Mrs. Thompson will write to petitioners and request that they call the police or dog officer if the dogs are barking and if they see a bonfire to call mutual aid.
*** DISCUSS LETTERS FROM VILLAGE WATER DISTRICT

Mrs. Thompson will write a memo to Mr. Wright, Emergency Management. The selectmen would like him to know that we’re in the process of reviewing generators and would like him to explore installing a switch so the generator can be used at another location in town. We would like his recommendation for where it should be and why it should be there.

· Trailer - We have already contacted our attorney in regards to this.
· Dead Trees – The board would like Mr. Cuomo to look at these trees.
Mr. Edward Davis came in and asked to speak with the selectmen. He stated has talked to Mr. Manhoff’s son and he has agreed to sell Mr. Davis the property his father owned at Woodbrook. Mr. Davis said that there is over $37,000 in back taxes, interest and penalties that are owed on these two lots. Mrs. Silverman asked for Mr. Manhoff’s phone number. Mr. Davis would not disclose it. Mrs. Silverman said that one of the problems is that although there are a lot of back taxes owed, the town will not take a tax deed because then it would obligate the town to pay condo fees. We have discussed this with the president of Woodbrook, Mr. Spector and there may be something that could be worked out with Woodbrook in the future. Mr. Davis would like Mr. Manoff to sell the lots directly to him. Mr.
Davis would like to negotiate the taxes owed. He asked the selectmen to give him the “rock bottom” price on what the board would accept for the taxes due. He doesn’t want an answer now but said that if the board will come up with a reasonable figure on back taxes he will take it from there. Mr. Davis gave Mrs. Thompson his address and we will write to him regarding his questions.
After Mr. Davis left the selectmen discussed this. At this time they will not take any action in regards to negotiating the taxes. The board would like to wait until they find out about any kind of agreement they can make with Woodbrook.
*** REVIEW AND DISCUSS HOMELAND SECURITY GRANT PURCHASES – Mrs. Knight signed the grant applicaton.
*** LETTER FROM GOVERNOR FAMILY -
This letter complements Mrs. Stark on her work with the summer recreation program and how she handled a situation with their son was injured at the baseball game. We will put a copy of the letter in Kathy Stark’s personnel folder and also give her a copy.
*** NOTICE FOR INFORMATIONAL MEETING ON TROY MILLS LANDFILL PROJECT

The board assigned the lots the numbers 12, 13 & 14. We will make these changes.

*** DISCUSS COORESPONDANCE FROM JIM BASSETTE REGARDING SAGA TOWER CONSTRUCTION –
The selectmen discussed the effect of the new plot plan that Saga has submitted. They agreed that Saga has brought the placement of the tower into compliance with the decision of the Planning Board by placing it at least 50 feet from the boundary lines. The selectmen discussed the difference between the verbal statement of Saga’s representative at the public hearing that the tower was at least 50 feet from the lot line and the original map that was submitted without measurements that turned out to be closer the 50 feet. They talked about what the ultimate outcome of this is. If the selectmen referred Saga back to the Planning Board the Planning Board would give them official approval of their map. The selectmen would like Saga to submit their construction permit for the tower and building
with an addendum stating that they have located both of these structures in compliance with the Planning Board’s criteria in the approval. The permit application needs to include an accurate map/plot plan showing the location of the tower and building with all setbacks clearly indicated. The selectmen will then forward this to the Planning Board for them to approve as a clarification of the original site plan approval. The selectmen feel that it is not necessary for Saga to meet with the Planning Board. This can just be done at their regular meeting. The selectmen would like Mrs. Thompson to let them know when the next Planning Board is meeting is.
The selectmen feel that the proposal to give the town $25,000 for the bond requirement is fine. We will call our auditors to find out how to handle this.
*** REVIEW COORESPONDANCE FROM INSURANCE CO. ON CRUISER DAMAGE – We pay the first $1,000 and the insurance will pay the balance. The total estimate is a little less than $2,000.

The board discussed the possibility of amending the sign ordinance to allow flags as a temporary, allowed use. They talked about placing the sign applications, review and approval under the planning board. The selectmen would still be the enforcement arm. It seems to make sense that the sign process be included in the site plan review application and approval process. The selectmen would like to have a sign applicant submit a picture of their completed and installed sign after they are done. This would serve as a record of how the sign existed upon installation and could be used in the future to establish what was where and when.
The selectmen would like a letter sent to Steve Filipi reminding him that he can not begin cutting timber until the intent to cut is signed.

ZBA meeting – Mrs. Silverman said the meeting was extremely long. The Eddy case shouldn’t have been excepted. They had nothing to appeal. The other case was John Holman with sheds and gazebos/construction materials. Mrs. Silverman is concerned that the ZBA didn’t reason through the criteria. They don’t seem to understand what their job really is. They end up getting caught up in questioning why the case was referred to them. The members get the materials over a week before the case but it seems as if they aren’t looking at it ahead of time. Suggestion to have someone from NHMA to come down and meet with ZBA, Planning Board and selectmen and talk about flow chart – how do the boards deal with this etc.
