Selectmen's Meeting Minutes 02/09/05
BOARD MEETING MINUTES
February 9, 2005

Selectmen Present:   Mrs. Silverman, Mr. Clukey, and Mrs. Knight

Mrs. Silverman convened the meeting at 9:30am.  


PRIMARY:

9:45am  MEET WITH CONSERVATION COMMISSION MEMBERS:  Mrs. Knight stated that her biggest concern is being a part of the negotiations.  Conservation Commission members Dorothy Zug, Katie Metzger, Barbara Green & Eleanor VanderHaygen met with the board.  Mrs. Zug questioned why the board changed the wording of the warrant article for the Conservation Easements.  Mrs. Silverman stated that the board was concerned with being a part of the negotiations at the beginning of the discussions.  We will change the wording of this article to read the Board of Selectmen and the Conservation Commission are to negotiate with the Monadnock Conservancy.   Mrs. Zug stated that any property that is placed in this will need to have a survey.  Mrs. Silverman stated that her concern is what the cost are and where the money is going to come from.  Mrs. Zug stated that they feel the money will be used from the change of use tax fund.       

10:00   TEMPLETON TURNPIKE/BRIDGE ISSUE
·       Gene Cuomo will be here:  Mrs. Silverman stated she reviewed the letter Bernie Waugh drafted, she feels that this letter is good, we will send this to Attorney Sheldon.  Mrs. Thompson spoke with Attorney Waugh this morning he is going to add a paragraph to this letter addressing Mr. Chamberlain’s statement that the Road Agent told him he could truck.  Mr. Cuomo stated that he feels that we should be able to meet with both parties and come to a compromise.  Mrs. Silverman stated that the whole issue is the size of this cut.  We will be meeting with Bernie Waugh Friday.  We will try to schedule this for 3:00.   Mr. Cuomo questioned if we can put limits on the number of trucks per day.  The legal load limit for a 5-6 axle tractor trailer truck is 86000 lbs.  Mr. Cuomo feels that we should limit the times that they can truck, he does not feel that they should truck when there would be a school bus on this road.   Mr. Cuomo stated he feels that we need to determine who is the legal owner of this property and whom we should be dealing with.   Mrs. Silverman feels that we should still investigate what is involved for a bond.   Mr. Cuomo stated that he has #4 Road on the list of projects for this year. He feels that we should postpone this project until after this logging is done.  He might do the ditching and repair the culverts this year, but postpone the paving.          

***     DISCUSS CLASS VI ROAD POLICY:  Mrs. Silverman would like to draft this policy.  She would be happy to finish the GPS points after winter.   

***     DISCUSS DRUG/ ALCOHOL TESTING:  There have been a few instances the Firewards feel that a firefighter has arrived at the scene under the influence.  Ms. Carney is questioning if there is anything we can add to our personnel policy that can require an individual to complete a drug and alcohol test if they feel it is necessary.  They would also like to complete criminal background test and driving records when individuals apply to the Fire Department.  Mrs. Knight feels that this should be completed.  Mrs. Thompson will work on amendments to our personnel policy.   Mrs. Silverman stated that she is concerned with how the drug and alcohol testing will be implemented.     

***     SIGN FIRE WARDEN APPOINTMENTS:

***     EMAIL REGARDING FITZWILLIAM PUBLIC WELFARE ASSOCIATION – 1941:  Mrs. Sillanpaa will review the historic society records.   

***     LETTER FROM RICHARD TALBOT:  His letter stated that he would resign at the end of the fiscal year which is June 30, 2005.  The board rescinded this acceptance until this date.  

***     VACATION TIME
·       DEPUTY TOWN CLERK
·       TOWN ADMINISTRATOR

***     RSA REGARDING BUILDING PERMITS TO BE WITHHELD PENDING VOTE ON GROWTH MANAGEMENT ORDINANCE:  

***     REVIEW 2005 BUDGET – PUBLIC HEARINGS TOMORROW NIGHT FOR SPECIAL REVENUE ACCOUNT AND BUDGET:  The Fire Department handed a  revised budget to the Budget Committee.  The amount they submitted was $50,430.  They included the repair for the tanker in their operating budget.  The Selectmen are revising our recommendation to this amount.  

***                  REVALUATION:  Mr. Parker told Mrs. Thompson that the Budget Committee cut  $9000.  They feel that the pickups can be part of the update.  They also do not feel that we should be having the data entered by Vision, this can be done in house.  Mrs. Thompson stated that they did not include the $3700 for the maintenance contract.  Mrs. Silverman feels that we can do the data entry in house.  She feels that we should discuss this with the Budget Committee and come to a compromise and ask them to put $5000 back in this budget.  Mrs. Silverman feels that if they will not, we ask for this money at Town Meeting.                 

 ***                Code Enforcement:  The Budget Committee cut $1900.00 for salaries.  The board feels that this is way to much.  They will cut $600 from this budget.
 

***     DECIDE ON ATTENDANCE FOR REGIONAL DINNER 4/13/05

***     NON-PUBLIC SESSION – PERSONNEL EVALUATION
                               At 11:35 AM, Mr. Clukey made a motion to go into Non-Public Session
                        under RSA 91 A:3 II  (a). Mrs. Knight seconded the motion. The  
                        motion passed 3-0.  Roll  Call Vote;   Mr. Clukey – yes, Mrs. Knight –
                        yes, Mrs. Silverman - yes.
                         At 11:40 AM. Mr. Clukey made a motion to go out of Non-Public Session
                        under RSA 91 A:3 II  (a). Mrs. Knight seconded the motion. The
                        motion passed 3-0.

***                  ZBA Hearing:  Mrs. Silverman stated that she questions if Mr. Patton’s building is an abandoned structure.  The ZBA made it very clear when they denied this application that he would only be allowed to rebuild in the same footprint.  

***                  SPICER SUBDIVISION:  Mr. Cuomo stated that he went on the site walk with the Planning Board.  He stated that Richmond Road is one of the worst roads in town.   He feels that 5 driveways on Richmond Road would be very hazardous.      

****                AMBULANCE INTERCEPT:    They will be billing the town for these services.    We will need to put money in an operating budget to cover this.  The Firewards are suggesting putting $6,000 into the health budget for this service.    Mrs. Thompson will draft a memo to the budget committee members with regard to this matter.  

***                 John Holman Pole Barn:  Mrs. Thompson looked at the RSA and this states that the building cannot be dependant upon the street.  She looked up the definition in our code of building.  It states that it is a structure with walls.  According to our definition this is a structure since it does not have walls.    Mrs. Silverman feels that we do not have a legitimate way to give him the permit.  He would need to go to the ZBA for an appeal for an administration.
