BOARD MEETING MINUTES
June 8, 2005

Selectmen Present:  Mrs. Knight,  Mr. Clukey and Mrs. Best

At 7:00pm, Mrs. Knight opened the meeting.


PRIMARY:

7:15            MEET WITH SHELDON SPECTOR – WOODBROOK AGREEMENT:
Mr. Spector stated he was here to talk about the status of the agreement that was drawn up. Their big issue is the hazardous trailer. He said that they made verbal proposals and met with the board and agreed that their attorney would draw up an agreement for the two Manhoff lots and the Rybak lot. Mr. Spector stated that all of these lots the individuals who owned them are deceased.  Mr. Spector stated that  Woodbrook had written off the condo fees.  Mrs. Knight stated that in their condo agreement they could remove the dilapidated trailer.  Mr. Spector stated that since we have a lien the town could sue them if they removed this.   Mrs. Thompson stated that we had told them that they could remove this trailer.   Mrs. Knight stated that the board agrees that this trailer should be removed.  Mrs. Knight stated that our concern is that we felt this agreement was for all lots that could be tax deeded not just ones that are behind on their condo fees.  The town is concerned that this gives the impression that as long as you are paying the condo fees you do not have to pay the taxes.   Mr. Spector stated that they were under the impression that we had an agreement based upon only the three properties.  Mr. Spector stated that he feels that this is a completely separate issue the lots that are not in arrears for condo fees.    Mr. Spector stated that the board wishes to get the agreement signed for the three properties.  Mr. Spector stated that he spoke with Mrs. Thompson and he stated that they could not forgive the condo fees for eighteen months.  Mrs. Knight stated that we normally would take a property, the reason we haven’t taken these properties is that we do not want to make the condo fees.  Mr. Spector stated that the reason they filed suit in the past was that the board of Selectmen stated that if they didn’t like it sue, which is what they did.  Mrs. Thompson stated that she feels that people want to stay at Woodbrook that are paying the condo fees.  She feels that if these people receive a letter stating that we are going to take their property they will make their tax payment.  The next condo fee is not due until October 31.  This would give the town 6 months to sell the property.  They would help us sell. They would set a reasonable time for us to notice and sell and condo fees wouldn’t be due until after a set time – say six months. Mr. Spector would put this information into their newsletter to make people aware that they have to pay their taxes.  
Wood brook would agree to forgo condo fees for six months and this period will start on such and such a date. They don’t want it to be open. They want to know exactly who the others are that are eligible. Mr. Clukey stated he feels that we still shouldn’t have to pay the condo fees if the land doesn’t sell. Mr Spector says that’s the risk you take – there’s risk involved in everything.   Mandra and Ryan are paying condo fees.  Mandra owes part of the April 2005 fees.  Andy Clukey feels that it should be seven months waiver of condo fees.  Mrs. Thompson feels that the board needs to know how many lots and what our potential liability would be.  Mr. Spector stated that he would like a copy of this list.  Mr. Spector questioned if we could get the agreement for the other three properties signed.  Mrs. Knight stated we would need to wait until we speak with our attorney.  

***                 Bob Dunton:  Mr. Dunton stated that he would like a children caution sign on East Lake
                     Road on either side of his house.  Mrs. Knight stated the board needs to speak with
                     Chief Newton with regard to this issue.   Mrs. Knight stated that they may need to put up
                     a speed limit sign if there is not one in this area.  Mrs. Knight stated that we will request
                     the police make an effort to patrol this area.    

                     Mrs. Knight stated that the board has received a quote from Howes Landscaping and
                     they would charge $60 to mow the Depot Park.  Mr. Dunton stated that this is a lot more
                     then what we pay the workers.  Mrs. Knight questioned how long it would take him to
                     complete this work.  He stated that it takes about 2.5 hours.    Mrs. Thompson stated
                     that each of the workers put in two hours each this week for the Depot Park.   Mrs.
                     Thompson stated that the board was feeling since we only have two workers this year
                     they could concentrate on the cemeteries.  Mr. Dunton stated that this is all we had last
                     year.     Mrs. Knight stated that we had planned on three people and due to the rain they
                     are behind.    Mrs. Knight stated that we are trying to relieve some of the workload, this  
                     does not mean that he cannot do the flowers and other items.  Mr. Dunton stated that he
                     takes great pride in this park.  Mr. Dunton stated that he does not feel that the park will
                     look any better with someone else doing this work.  Mrs. Knight stated that it’s not to
                     make this look better, it is to free up time for the cemetery.   Mrs. Knight requested that
                     Mr. Dunton provide the cost now, he stated that Paula has this information.   Mr. Dunton
                     stated he feels that if there are complaints they should go to him.  The board agreed.               
                         
***             COMPLAINT REGARDING CONDITION OF CEMETERIES ON MEMORIAL DAY:   
                      We received a complaint with regard to the condition of the cemeteries on Memorial
                      Day.   This individual felt that the grass was not mowed and flowers where not planted.  
                      Mr. Clukey stated that the Mr. Dunton called him and stated he felt the cemeteries were
                      in good condition.  The board did receive a quote from Howes Landscaping and they
                      submitted a bid for $60.00 to mow the Depot Park.   

***             POLICE DEPARTMENT REQUISITIONS:
                       Bullet Proof Vest:   The board approved this request.

                        Computer:   This was budgeted for.  The board approved this request.   

***             DISCUSS STATUS OF BUILDING PERMIT TAX MAP 23 LOT 13:  This is Cheryl
                     Welch’s property.   Mrs. Favreau stated that in reviewing the building permit Mrs. Welch
                     submitted the plans indicating 2 full stories.  The previous house was 1.5 stories.  We
                     have received a letter from Shoreland Protection since Mrs. Welch submitted her permit
                     which states that a waiver is required when expanding non-conforming structures
                     including height.  Mrs. Favreau passed this information on to Mrs. Welch whom became
                     very irate.    The board agreed that if the State is requiring a waiver a permit cannot be
                     granted until this has been obtained.        

***     REVIEW POLICE PROSECUTOR REPORTS:  Reviewed

***     REVIEW LETTERS TO SCHOLARSHIP RECIPIENTS FROM VARIOUS TRUST FUNDS:  Reviewed

***     UPDATE ON BRIDGE PROJECT ON TEMPLETON TURNPIKE:  Mr. Cuomo is expecting the bridge to be closed next Wednesday.  Mrs. Thompson sent letters to the three house beyond this bridge stating that they will need to make arrangements to park their vehicles on the other side.   Mr. Cuomo expects to spend a 14-16 hour day working on this project.  


***                 UPDATE ON ASSESSMENTS:  We have started the process of the sales study.     Mrs. Thompson has created a list of all properties built prior to 1920. We are reviewing these and will be measuring, listing and walking through all of them in order to make sure they are categorized correctly. We will incorporate these homes into our 1/3 of the study.
***     WORKSHOPS:

There being no further business, at 9:05 PM Mrs. Knight made a motion to adjourn.  Mr. Clukey seconded and the motion passed 3-0.
