BOARD MEETING MINUTES
June 25, 2008

Selectmen Present:  Carmen Yon , Chmn., Michael Methe & Thomas Parker  

Chairman Carmen Yon opened the meeting at 2:00 PM



PRIMARY:

2:00            DISCUSS OUTSTANDING ABATEMENT APPLICATIONS – FINALIZE WOODBROOK LETTER

Louise Bill – Gretchen Wittenberg and Louise Bill came in two weeks ago – they agreed that Jones and Bill have the same view and that the Selectmen were going to increase the Jones view. No reduction in Bill’s view was discussed at the meeting. Mr. Methe feels we should increase the view on the Jones property  to $50,000 and leave Bill’s the same. Mr. Parker stated that he would do the opposite – reduce Bill to $35,000. The selectmen looked at other properties with views to compare. Mr. Methe made a motion to assess both Bill and Jones at $50,000 view. Mr. Yon seconded and the motion passed 2-1 with Mr. Parker voting no.

Watson – Avitar inspected the property and made a number of changes that result in a recommendation of a reduction of value. Mr. Methe made a motion to accept Avitar’s recommendation and reduction in value. Mr. Yon seconded and the motion passed with Mr. Parker abstaining.

Slavic – Map 14 Lot 04 Avitar looked at the house that the kitchen and electric has been removed – building is abandoned. Mr. Yon made a motion to accept Avitar’s recommendation. Mr. Parker seconded and the motion passed 3-0. Change assessment for 2008.

Rumph – Mr. Yon moved to deny based on unavailability to schedule inspection. Mr. Parker seconded and motion passed 3-0.

Mr. Methe would like three or four color copies of the sales book with the views and have each of the three selectmen rate the views based on the written criteria.

John Damon – Map 4 Lot 75 – Mr. Methe made a motion to reduce the land condition to 100% from 150%. Mr. Yon seconded and the motion passed 3-0. Map 4 lot 38-01 Mr. Yon moved to reduce to $1,500, Mr. Parker seconded and motion passed 3-0.

Mr. Parker made a motion to meet with Certified to discuss a contract. Mr. Yon seconded – passed 3-0. Mr. Parker voted to go ahead with a fee schedule effective July 1st , Mr. Yon seconded and motion passed 3-0. Paula scheduled Certified for July 9th at 11am.  We will call Nancy Carney  and invite her to this meeting.

Carole Krunklevich – She has included a number of properties she feels are comparable. There are differences in square footage. Mr. Yon moved to change to Average +10.

Donald Bailey – Map 11 Lot 51 – Mr. Methe made a motion to take Avitar recommendation, Mr. Yon seconded and passed 3-0.

Dunton, Charles and Patricia – Map 28 Lot 12 – Mr. Parker moved to accept Avitar’s recommendation to reduce assessment. Mr. Methe seconded and passed 3-0.

Bequaert – Mr. Yon made a motion to deny, Mr.Methe seconded, motion passed 3-0.

Map 42 Lot 02-09 – Change base rate to 43 from 60. Mr. Parker moved, Mr. Yon seconded and passed 3-0.


4:00            MEET WITH MARK SWEENEY –  Mr. Sweeney submitted his Junk Yard survey  report. Mrs. Thompson  will prepare
                             letters for Board of Selectmen  signatures.

***             County Budget – 16.1% increase on budget. Increase of $5 million dollars to municipalities – 34.7% increase burden
                             on municipalities.   We will put an article in the August newsletter.  The Board of Selectmen would like to write letter
                            to Barbara Richardson and Molly Kelly. Also letter to county commissioners – deplorable to pass this onto the
                           property tax payers at a time when people are stressed to the max. For a level of government that provides little
                           service to anyone but your employees (cc. B. Richardson, M. Kelly).

7:15pm          MEET WITH BOB DESROSIERS – PUBLIC HEALTH:  Mr. Yon stated that we currently do not have a health officer.   
                             Mr. Desrosiers stated that he worked for the City of Keene for 39 years.  He currently works for  the Town of
                             Swanzey.   Mr. Parker stated that we have a septic failure question.  We also have a property that the town has taken
                             for tax deed.  The people renting the property had moved out of the property, and have now moved back into a travel
                             trailer on the property.    Our attorney has recommended that we treat this as a tenant issue.  We may need to have
                             the property inspected to determine if this is habitable.   

                             Mr. Parker stated that the town does not have an adopted building code.  

                             Mr. Yon questioned if he wanted a contract.  Mr. Desrosers stated that he does not need one.  His  hourly rate is  
                             $28 an hour and .505 per mile.        

7:45            MEET WITH ARNIE FILIPI – LAND USE CHANGE TAX ABATEMENT APPLICATION:   The board reviewed Mr.
                             Filipi’s abatement application.   Mr. Filipi stated that larger lots in town have sold for $60,000, his lots are smaller.  
                             Mr. Filipi stated that he sold these lots with the houses on them.   Mr. Methe stated that the board came up with
                             $60,000 as the basis for a basic building lot.    Mr. Yon stated that lot 02 is an odd shaped lot and has been
                             discounted by  Avitar, based upon what the assessment is for this lot Mr. Parker stated that he would change this
                             assessment based upon $50,000, the motion was seconded by Mr. Yon, the motion passed 3-0.      

8:00            MEET WITH RACHEL SWEENEY :  Mrs.  Sweeney met with the board.   Mrs. Sweeney stated that they have been
                             paying for the property  they lived in.  Mr. Parks is her ex- step father .  Mr. Parker stated that Mr. Parks did not pay
                             the taxes.   Mrs. Sweeney stated that she spoke with the Tax Collector a couple of  months ago, and questioned if
                             they paid the taxes by the end of the summer if this would be okay.   She stated that Mrs. Wright did not think it would
                             be a problem.    Mr. Parker stated that the board cannot give them credit for any money they have given to Mr. Parks.  
                             Mr.  Parks has rights as the former owner of the property if he makes payment on the taxes.  If he does not do this
                             we would sell this by bids or auction.  The only way to get it directly is for Mr. Parks to make full payment.   Mr. Parker
                             stated that we are bound by State law with regard to the procedures.    Mrs. Thompson stated  that Mr. Parks would
                             be sent a repurchase notice by certified mail.  He has 30 days to notify that he wished to repurchase, he has 10 days
                             to make payment, within 90 days if he does not respond, the Board of Selectmen can sell the property.     Mrs.
                             Sweeney questioned if she could get  something in writing with regard to them getting evicted.  Mrs. Thompson
                             stated that we do not have any paperwork  yet, our attorney needs to file the paperwork.                 

8:15            MEET WITH DAVE WHITE:  Mr. White was given his building permit

***             RESIGNATION OF TOWN TREASURER: Mr. Parker made a motion to accept Mary Tommila’s resignation. Mike
                             seconded. Motion passed 3-0

***             APPOINT TREASURER AND DEPUTY TREASURER: Mr. Parker made a motion to appoint Donna Hill Treasurer           
                             and Diane Cornwell as deputy. Methe seconded and motion passed 3-0.

***             TIMBER TAX ASSESSMENT – TAX MAP 03 LOT 31-03:
                                 Access: 1
                                Quality: 1
                                 Quantity: 1  Total 50%

***             OCCUPANCY PERMIT – MAP 10 LOT 68-06:  Mr. Parker moved to approve, the motion was seconded by  Mr.
                              Methe, the motion passed 3-0.

***             BUILDING PERMITS:
·       MAP 25 LOT 09-01:  Mr. Parker moved to approve, the motion was seconded by Mr. Methe, the motion passed 3-0
·       MAP 25 LOT 09: Mr.  Parker moved to approve, the motion was seconded by Mr. Methe, the motion passed 3-0
·       MAP 04 LOT 57-07:  Mr. Parker moved to approve, the motion was seconded by Mr. Methe, the motion passed 3-0
·       MAP 10 LOT 23: Mr. Parker moved to approve, the motion was seconded by Mr. Methe, the motion passed 3-0
·       MAP 15 LOT 44-02: Mr. Parker moved to approve, the motion was seconded by Mr. Methe, the motion passed 3-0

***                         BUILDING PERMITS:  Mr. Parker stated that he feels when we issue a building permit to people of who were burned
                             out this is replacement not a new structure.     Mr. Parker made a motion  we are replacing a house for house and
                             this is not subject to growth management, Mr. Yon seconded passed , the motion passed 3-0.  The board will waive
                             the fee.   

                             Mr. Parker stated that if a building permit is submitted for major renovations he feels that  if we do not have a septic
                             on file, then we need a plan.  

***             DISCUSS LAYOUT OF ROYALSTON ROAD – ATTY LITTLE’S LETTER:   Attorney Little is asking for a copy of the
                             minutes from the Public Hearing.  Mr. Parker stated that in the  hearing Mr. Little states the two  little pieces of land      
                             between Sportsman’s Pond and Derby Mill Road belong to Mr.  Dwinell.     Mr. Parker feels that we need to make an
                             offer and then change the plan to 2 ½ rods wide, in turn we expect an easement and include the triangle of land that
                             is in the center.    He would like a letter from Vorce that our settlement with Dwinell covers his cost.  Mr. Yon would
                             like a  letter from Mr. Vorce stating the he will not pursue the invoice with the town for work that he had no contract.    
                             Mr. Dwinelll will need to give the land free of any encumbrances.  We will take a deed for everything that Dwinell is
                             losing.   If  Dwinell does not accept we will give value that Gary assessed.  We will contact Waugh for wording, need
                             redrawing from Graz.

                                At 8:40 PM, Mr. Yon made a motion to go into Non-Public Session under RSA 91 A:3 II  (a).  Mr.  Parker seconded
                             the  motion. The motion passed 3-0.  Roll Call Vote;  Mr. Yon - Yes & Mr. Parker - yes
                               At  8:45 PM. Mr. Yon made a motion to go out of Non-Public Session under RSA 91 A:3 II  (a). Mr.  Parker
                             seconded the motion. The motion passed 3-0.


***             WENDELL:  reviewed

***             FIREWORKS PERMIT – FLEUR DE LIS CAMP:  Mr. Parker moved to approve, the motion was seconded by Mr.
                             Methe, the motion passed 3-0.

***             NON-PUBLIC SESSION – PERSONNEL EVALUATIONS:  

***             ACCEPT SIGN DONATIONS:  Chad Beede, Fitzwilliam Newsletter, Charles Tenney:  Mr. Parker moved to accept,
                             the motion was seconded by Mr. Methe, the motion passed 3-0.

***             ELM TREE DONATION:  Mrs. Thompson received a call from Roxanne Monteverde she works for this organization.  
                             We do not need to take possession of this until the fall.     Mr. Methe moved to accept this donation, the motion was
                              seconded by Mr. Yon, the motion passed 3-0.  

***             DRAFT FINANCIAL STATEMENTS:   To be reviewed

***                         CROSSWALKS:   Mr. Methe would like to see a couple of crosswalks put in for the crossing at Fleur Dis Lis.  

***                        JUNK YARDS:  We have not  received the completed information from Bailey’s.  Mr. Methe would like to send a letter
                             to Mr. Bailey stating his failure to respond to previous letter and he has 10 days to respond or we will turn this over to
                             the State.   

                            Car Guyz:  We have the completed application. We will schedule a public hearing.   Thursday July 17

***                       Town Hall projects:   Mrs. Thompson spoke with John Greer he is busy for the next few weeks.   

***                       Keeses Change of Use:  This lot is assessed at $36,400 as undeveloped.   Mr. Methe would stick with the premises
                           that they set building lots at $60,000.  Mr. Parker would assess at $50,000,  the motion was seconded by Mr. Methe,
                           the motion passed 3-0.  

***                       FIRE DEPARTMENT: Mr. Parker is questioning that we pay a member of Meadowood as a fire department member of
                           Fitzwilliam when they attend fires.   Mr. Yon stated that we need to bring up this issue with the Firewards.   

***                        VETERANS FARM:   Mr. Parker questioned if we should send a letter confirming that we are keeping the tax status
                            as taxable.     

***                        The board would like to schedule a meeting with the budget committee.
