ZBA Meeting Minutes 02/14/06
Members Present: Jane Roberts, Chairman, Ashley Fletcher, Coni Porter, Dianne Schott, Gretchen Wittenborg, and alternates Baker and Filipi.
Meeting was called to order at 7:00 PM

Case #06-02:  Terry Gilbert appeals administrative decision of Board of Selectmen, based on Section 127-9 of the Land Use Ordinance, denying her request to live in her mobile home while she build a new home on the property, located on Route 12 South, Map 4, Lot 79-02, Rural District.

Roberts asked Ms. Gilbert when she planned to move the mobile home.  She responded that it would be moved when the new home was ready for occupancy and the landscaping around the trailer could be transplanted to the new home site.  They think it will take about three months to build the home but the trailer can’t be moved until the field dries enough to pull it out.  She understands that the certificate of occupancy will not be issued until the mobile home is moved.

Filipi said in his experience a certificate of occupancy is issued after inspections are complete, on condition the mobile home is moved within 30 days.  

Wittenborg and Schott said that technically there is no second dwelling on a site until the certificate of occupancy is issued.  The Board agreed.  Given that, the Board wondered why this case was before them in the first place.

However, Schott moved, Fletcher seconded and the Board approved a motion to grant Ms. Gilbert her appeal of the Selectmen’s administrative decision, instructing that a building permit be issued for construction of a building to be completed within one year of issuance, on condition that the mobile home is removed prior to an unconditional certificate of occupancy being issued.

Because the Board believed the case to be unnecessarily before them, Porter moved, Fletcher seconded and the Board approved a motion to fully refund the application fee and abutter notice fees to Ms. Gilbert, a total of $75.00.  

Minutes: ~The Board reviewed minutes of the January 10, 2006 meeting. Fletcher moved, Porter seconded and the Board approved the minutes as written.

Fletcher moved, Porter seconded and the Board adjourned at 7:35 PM.
